Tonia Hennessee Martin, former teacher’s aide at Rogers Creek Elementary School, Athens, Tennessee, has admitted to engaging in sex with a 16-year-old boy but didn’t plead guilty to two counts of aggravated statutory rape and solicitation of a minor she was charged with.
Investigators first learned about the allegations in January when the victim and his parent filed a complaint. At the time of the accusation, Martin had been a teacher’s aide at Rogers Creek Elementary School for six years but resigned three weeks later. In February Martin surrendered after she was indicted on charges of aggravated statutory rape and solicitation of a minor.
The teen aged victim was an ex-boyfriend of Martin’s own daughter. According to McMinn County sheriff’s investigator Eric Allman. “Her daughter had no knowledge of this”.
Martin acknowledged in McMinn County Criminal Court in August 2011 that she had sex with the boy on two occasions. Martin did not enter a guilty plea, but applied for diversion and a judge granted her request.
A court clerk said if Martin stays out of trouble for two years, she can ask to have her record cleared.
Martin’s agreement said that she is to have no contact with the victim, must stay off school grounds, and can not attend any school functions. She is also liable for all court costs.
